Experts point out that while missing the deadline does carry consequences, there are still provisions available for taxpayers to remain compliant.

The deadline for filing Income Tax Returns (ITR), even after the government’s extension, has now closed. Many individuals who were unable to meet the extended timeline are wondering what their next steps should be and what implications they face for late filing. Experts point out that while missing the deadline does carry consequences, there are still provisions available for taxpayers to remain compliant.

One of the most important options is the filing of a belated return. The Income Tax Department allows taxpayers to file their ITRs even after the due date, but with certain conditions and penalties. A belated return must be filed before the close of the assessment year, meaning individuals still have time to fulfill their obligations, albeit with some restrictions.

Filing a belated return comes with a late fee under Section 234F of the Income Tax Act. Taxpayers may be required to pay a penalty of up to Rs 5,000, depending on their income bracket and the timing of the delayed filing. Those with incomes below Rs 5 lakh will face a lower penalty, usually capped at Rs 1,000. Interest on unpaid taxes may also be applicable, which makes early compliance crucial.

It is important to note that filing late may limit certain benefits. For example, losses under the head “Capital Gains” or “Business and Profession” cannot be carried forward if the return is filed after the deadline. However, taxpayers will still be able to claim deductions for eligible expenses and investments made during the financial year. This makes filing a belated ITR far more beneficial than skipping it altogether.

In addition to belated returns, the Income Tax Department also provides the option of filing an updated return, introduced under the Finance Act 2022. This facility allows taxpayers to rectify omissions or errors by filing an updated return within two years from the end of the relevant assessment year. While this option provides flexibility, it does come with an additional tax liability, as individuals must pay extra taxes along with the updated filing.

Tax professionals recommend that individuals who missed the deadline act promptly to avoid further complications. Delayed filings increase the chances of receiving notices from the Income Tax Department, particularly if there are tax liabilities or discrepancies in reported income. Filing at the earliest opportunity ensures compliance, reduces the penalty burden, and secures peace of mind.

For salaried individuals, filing a belated return still allows them to claim refunds on excess tax deducted at source (TDS). Therefore, missing the original deadline does not necessarily mean losing the right to refunds, though the process may take longer.

In conclusion, while missing the extended ITR deadline can cause stress, taxpayers have options to correct the situation. By filing a belated or updated return, paying applicable penalties, and ensuring accurate reporting, individuals can stay compliant and protect their financial interests. The key is to act quickly and not delay further, as timely action minimizes risks and ensures smoother financial management.

For example, losses under the head “Capital Gains” or “Business and Profession” cannot be carried forward if the return is filed after the deadline.
