The Delhi government has officially informed the Supreme Court that it will defer the implementation of the Private School Fee Regulation Act for the 2025–26 academic session. The announcement came on February 2, following a court directive to the Directorate of Education (DoE) to review its plan to enforce the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025.
The 2025 law was designed to bring transparency and regulation to private school fee structures across the national capital. Its key objectives included ensuring uniformity in fee fixation, preventing arbitrary fee hikes, and mandating clear disclosure of fee components for parents. However, soon after the Act was passed, several private school associations expressed concerns about its practical implementation, claiming that certain provisions could impose undue financial and administrative burdens. These associations approached the Supreme Court, seeking a temporary stay on the law for the 2025–26 academic year.
In response to these concerns, the Delhi government decided to delay enforcement, pending further consultations with stakeholders. The Supreme Court was informed that the government would review the law, taking into account the feedback of private schools, parents, and regulatory authorities. This step ensures that the act is implemented effectively without causing disruption to ongoing academic operations.
Experts note that while the regulation aims to promote transparency, the practical challenges of uniform enforcement across hundreds of private schools in Delhi required careful assessment. Fee structures in private schools vary widely based on infrastructure, facilities, curriculum, and operational costs, making standardisation complex. The deferral provides the government time to consider these factors and possibly refine the provisions to ensure a fair and workable framework.
The Delhi government also emphasised that the temporary delay does not affect its commitment to regulating school fees. Officials have indicated that consultations with education experts and school management bodies will continue, aiming to finalise an implementation plan that balances transparency for parents with the operational autonomy of schools.
This move comes amid growing public debate about the affordability of private education in the capital. While parents welcome measures to curb arbitrary fee hikes, schools seek flexibility to maintain quality education standards. The Supreme Court is expected to review the government’s progress and may provide further guidance on the act’s eventual rollout.
As a result of this announcement, parents, students, and school administrators in Delhi can expect continuity in fee structures for the 2025–26 session, while authorities work on a more structured and enforceable framework for future academic years. The deferment also underscores the need for balanced policy-making that protects both students’ interests and schools’ operational capabilities.
