The Allahabad High Court has clarified that a second maternity leave request cannot be rejected merely on the grounds that it is made within two years of a previous leave. The ruling was delivered by Karunesh Singh Pawar at the Lucknow bench while hearing a petition filed by Manisha Yadav.
The case arose after Manisha Yadav challenged an order dated April 4, 2026, which denied her request for a second maternity leave. The rejection was reportedly based on provisions in a financial handbook that placed restrictions on granting such leave within a specific time frame. The petitioner argued that the denial was inconsistent with her legal rights under applicable maternity laws.
While examining the matter, the Allahabad High Court observed that statutory rights granted under maternity related legislation cannot be overridden by administrative guidelines or financial rules. The court emphasised that laws enacted to protect maternity benefits are intended to support the health and well being of both mother and child, and therefore must be given priority.
Karunesh Singh Pawar noted that denying maternity leave based solely on a time gap between two requests would not align with the purpose of such legislation. The court highlighted that maternity benefits are a legal entitlement and not a discretionary provision that can be restricted by internal administrative policies.
The judgment reinforces the principle that statutory provisions hold precedence over departmental instructions. This means that if a law provides certain rights, those rights cannot be limited by internal rules unless explicitly allowed under the law. In this case, the court found that the administrative basis for rejecting the leave request did not align with the legal framework governing maternity benefits.
Legal experts note that the decision may have broader implications for employees across various sectors, particularly in government and public service roles where such administrative guidelines are commonly applied. The ruling is expected to provide clarity on how maternity leave requests should be handled when there are apparent conflicts between statutory rights and internal policies.
The judgment also reflects ongoing efforts within the judicial system to interpret laws in a manner that upholds employee welfare and gender equality in the workplace. Maternity benefits are considered an important aspect of labour rights, aimed at ensuring that women are not disadvantaged due to pregnancy and childcare responsibilities.
The case highlights the importance of awareness among employees regarding their legal rights. It also underscores the responsibility of employers and administrative authorities to ensure that their policies are in compliance with existing laws.
Following the court’s decision, the rejection order faced by the petitioner is expected to be reconsidered in line with the legal observations made in the judgment. The ruling serves as a reference point for similar cases where maternity leave requests are evaluated.
As workplace policies continue to evolve, the emphasis remains on aligning administrative practices with statutory protections. The decision of the Allahabad High Court reinforces the legal position that maternity rights must be respected and implemented in accordance with the law.
