In a significant legal development, a Jaipur court has rejected the anticipatory bail application filed by Royal Challengers Bengaluru fast bowler Yash Dayal in a case registered under the Protection of Children from Sexual Offences (POCSO) Act. The court’s decision came after hearing submissions from the special public prosecutor and the counsel representing the complainant.
According to court proceedings, the prosecution strongly opposed the bail plea, citing the serious nature of the allegations and the legal framework governing offences involving minors. The complainant’s counsel, Advocate Devesh Sharma, argued that anticipatory bail should not be granted in cases registered under the POCSO Act, particularly when the accused holds a position of public prominence. He further contended that as a well-known professional cricketer, the accused has a higher responsibility towards society and must cooperate fully with the investigation.
The court considered the submissions presented by both sides before rejecting the anticipatory bail plea. While detailed observations of the court are awaited, the rejection underscores the judiciary’s cautious approach in matters involving allegations under special protection laws meant for minors. Legal experts note that courts often adopt a stringent stance in such cases to ensure that investigations are not influenced or obstructed.
Yash Dayal, who represents Royal Challengers Bengaluru in the Indian Premier League and has played domestic cricket for Uttar Pradesh, has not publicly commented on the court’s decision at the time of writing. The case is currently under investigation, and authorities are expected to proceed with further legal steps in accordance with the law.
The POCSO Act was enacted to protect children from sexual offences and provides for strict procedures and safeguards during investigation and trial. Under the law, courts are generally cautious while considering anticipatory bail, especially when the allegations involve minors. Legal provisions also emphasise speedy investigation and trial to ensure justice for the victim.
The development has drawn attention due to Dayal’s status as a professional athlete. However, legal observers stress that the judicial process applies equally to all individuals, regardless of public standing. The court’s decision reflects the principle that allegations under special statutes are treated with seriousness and due process.
As the case progresses, further clarity is expected once the investigating agencies submit their findings. The trial court will examine the evidence before determining the next course of action. Until then, the matter remains sub judice, and no conclusions can be drawn regarding guilt or innocence.
The case highlights the legal responsibilities of public figures and the strict standards applied by courts in cases involving allegations under child protection laws.
