Congress Lawmakers Urge Justice Yashwant Varma to Step Down Amidst Impeachment Threat
A group of Members of Parliament from the Indian National Congress has urged Justice Yashwant Varma to resign from his judicial post in advance of a proposed impeachment motion. This development follows growing scrutiny surrounding Justice Varma’s conduct in certain judicial proceedings, which the MPs claim raises questions about judicial propriety and public trust.
In their joint statement to the press, the Congress MPs emphasized that their move is not intended to undermine the judiciary, but rather to uphold its dignity and independence. According to sources, informal discussions regarding the impeachment motion had already begun among opposition leaders in Parliament, with Congress spearheading the effort to address what they describe as "serious concerns" linked to Justice Varma’s recent actions.
Though the precise allegations have not been publicly detailed, MPs assert that there are credible questions regarding the judge’s impartiality and his handling of particular high-profile cases. These issues, they argue, merit either a transparent investigation or a voluntary resignation to preserve the judiciary’s integrity.
Impeachment of a judge in India is a rare and rigorous process. As per Article 124(4) of the Constitution, a judge can only be removed through a detailed process involving both the Lok Sabha and the Rajya Sabha, requiring a special majority. Historically, very few impeachment motions have progressed past the preliminary stages. The Congress MPs are reportedly considering all constitutional avenues before formally submitting the motion.
Senior Congress leader and Rajya Sabha member Jairam Ramesh said, “The judiciary must remain above suspicion. In situations where there is doubt, it is always better for the individual concerned to step aside rather than subject the institution to further public questioning.”
The move has drawn mixed responses from legal experts and political analysts. Some view it as a necessary check on judicial overreach, while others believe it could set a difficult precedent and politicize judicial accountability.
Justice Varma has not publicly responded to the resignation demand, nor has there been an official statement from the judiciary. Sources close to the judge reportedly describe the allegations as unfounded and politically motivated, suggesting that the timing of the appeal is meant to create pressure.
This episode highlights the ongoing tension between the judiciary and the legislature, particularly around matters of accountability, transparency, and ethical standards. While judicial independence remains a cornerstone of India’s democratic framework, mechanisms to ensure that judges adhere to the highest standards of conduct are increasingly being discussed in both legal and public forums.
The Congress party’s move may also serve as a signal of its intent to take a more proactive stance on judicial ethics in the coming sessions of Parliament. As the matter unfolds, it is likely to stir a broader national debate on how India balances judicial independence with institutional accountability.
