The Election Commission of India has taken strong exception to the West Bengal government’s handling of disciplinary action against two election officials and has sought a detailed explanation for what it termed a procedural lapse. The poll panel has asked the state chief secretary to ensure that the competent authority submits a written clarification by 5 pm on January 24.

The issue relates to the West Bengal government’s decision to unilaterally clear Baruipur Purba assembly constituency Assistant Electoral Registration Officer Tathagata Mondal of charges, while imposing only a minor penalty on Moyna assembly constituency AERO Sudipta Das. This action was taken despite explicit instructions from the Election Commission, issued on August 5, 2025, directing the state to suspend both officers and initiate formal disciplinary proceedings against them.

According to the commission, its earlier order had clearly stated that disciplinary authorities must consult the Election Commission before closing, finalising, or modifying any proceedings that were initiated on the commission’s recommendation. The West Bengal government’s decision to proceed independently was viewed as a violation of established protocol.

In its communication to the state government, the Election Commission emphasised that adherence to its directives is mandatory, especially in matters related to election administration and the conduct of poll officials. The commission noted that such actions undermine the institutional framework designed to ensure free, fair, and transparent elections.

The explanation sought from the state must outline the circumstances that led to the non-compliance with the commission’s instructions. The EC has asked for clarity on why its mandatory consultation requirement was not followed before exonerating one officer and reducing disciplinary action against the other.

Sources within the poll panel indicated that the commission views this matter seriously, as disciplinary oversight of election officials falls squarely within its constitutional mandate. Any deviation from its directions, officials said, could set a problematic precedent for future election-related administration.

The West Bengal government has not yet issued a public response to the Election Commission’s notice. However, the matter is expected to escalate if the explanation fails to satisfy the commission or if further procedural violations are identified.

This development comes amid heightened scrutiny of election processes across several states, with the Election Commission reiterating its authority over electoral conduct and the responsibility of state governments to comply with its orders. The commission has consistently maintained that cooperation between state administrations and the poll panel is essential for maintaining the integrity of the electoral system.

The outcome of the commission’s review will determine whether further action is taken against the officials involved or whether additional directions are issued to the state government.
