The Jan Suraaj Party, led by strategist turned politician Prashant Kishor, has moved the Supreme Court challenging the results of the Bihar Assembly Elections 2025 and has sought directions for conducting fresh elections in the state. The party has raised concerns over alleged violations of the Model Code of Conduct during the election period.

According to the petition filed before the apex court, the Jan Suraaj Party has objected to the alleged direct transfer of Rs 10,000 to women voters in Bihar ahead of the polling process. The party has claimed that the financial transfer was carried out while the Model Code of Conduct was in force, thereby influencing voters and undermining the fairness of the electoral process.

The writ petition is likely to be taken up for hearing on Friday by a bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi. The petition seeks cancellation of the election results and calls for fresh polls, arguing that the alleged distribution of funds compromised the principles of free and fair elections guaranteed under the Constitution.

The Jan Suraaj Party has contended that welfare announcements or monetary transfers during the election period amount to inducement and violate established election norms. The party has urged the court to examine whether such actions influenced voter behaviour and distorted the level playing field among political parties.

Prashant Kishor, who launched the Jan Suraaj Party after a long career as a political consultant, has positioned the party as a reform oriented political alternative in Bihar. The party has emphasized transparency, governance reforms, and institutional accountability as key pillars of its political agenda.

Legal experts note that election challenges before the Supreme Court are examined carefully, particularly when allegations relate to the enforcement of the Model Code of Conduct. The court may seek responses from the Election Commission of India and other concerned authorities before deciding on further action.

The Bihar Assembly Elections 2025 were held amid intense political competition, with multiple parties contesting across the state. While the results have already been declared, the Jan Suraaj Party’s petition has added a new legal dimension to the post election scenario.

The Election Commission has not yet issued a formal response to the petition. In previous cases, the commission has maintained that welfare schemes announced before elections are scrutinized in line with established guidelines.

The outcome of the Supreme Court hearing could have broader implications for election conduct and the timing of welfare measures during polling periods. The case is expected to draw close attention from political parties and constitutional experts, as it raises questions about electoral integrity and the enforcement of election rules in India.

The petition seeks cancellation of the election results and calls for fresh polls, arguing that the alleged distribution of funds compromised the principles of free and fair elections guaranteed under the Constitution.
