They said that detaining an elected representative without due parliamentary process undermines the credibility of the Assembly and the role of MLAs in representing their constituencies.

Srinagar, Jammu & Kashmir:

The detention of Mehraj Malik, a sitting legislator in the Jammu & Kashmir Assembly, under the Public Safety Act (PSA) has drawn sharp criticism from fellow lawmakers, who described the action as an attack on the democratic institutions of the Assembly and the rights of elected representatives. The PSA, which allows preventive detention for up to two years, has often been a subject of controversy due to its use against political figures and activists.

Speaking in the Assembly, legislators across party lines expressed concern over the implications of Malik’s detention on democratic governance. They said that detaining an elected representative without due parliamentary process undermines the credibility of the Assembly and the role of MLAs in representing their constituencies. Members stressed that such measures curtail legislative debate and prevent representatives from fulfilling their duties to the people.

“We are deeply concerned about the detention of our colleague Mehraj Malik under PSA. This is not merely about an individual but about the functioning of a democratic institution. Elected members must be allowed to perform their duties without fear or undue restrictions,” a senior legislator stated.

Lawmakers pointed out that elected representatives hold a constitutional mandate to voice the concerns of their constituents. Any action that hampers their ability to participate in legislative processes is detrimental to the democratic framework of governance. The Assembly members called for an immediate review of Malik’s detention and urged the administration to ensure that such actions are not used to suppress political expression.

The debate also highlighted the broader implications of the PSA in the Union Territory, with legislators noting its potential misuse against political leaders, activists, and opposition voices. The Assembly discussion emphasized that democratic institutions thrive when elected representatives can exercise their rights freely, without intimidation or preventive detention.

Political analysts suggest that Malik’s detention could trigger wider discussions on political freedoms in Jammu & Kashmir and the balance between security measures and democratic rights. They note that the PSA, while intended for preventive purposes, must be applied judiciously to avoid perceptions of political targeting.

In addition to condemning the detention, legislators urged the government to engage in dialogue with elected representatives to restore confidence in democratic processes. Members also emphasized that the administration should take steps to reassure MLAs that their legitimate duties will not be obstructed by preventive measures.

As the controversy continues, the situation has drawn attention from national political observers, human rights groups, and civil society organizations, all of whom stress the importance of upholding democratic norms in the Union Territory.
