Recently, BJP MP Nishikant Dubey filed a privilege complaint against Congress leader Rahul Gandhi, alleging that certain remarks were aimed at destabilising the country.

Om Birla has constituted the Committee of Privileges of the Lok Sabha, appointing senior Bharatiya Janata Party leader Ravi Shankar Prasad as its chairperson. The panel is one of the key parliamentary committees responsible for examining cases involving alleged breaches of privilege by Members of Parliament.

The 15 member committee includes eight representatives from the National Democratic Alliance and members drawn from various opposition parties. Its mandate is to investigate complaints that may involve violation of parliamentary privileges or contempt of the House. Based on its findings, the committee can recommend appropriate action, which may range from admonition to suspension or, in rare cases, expulsion of a member.

Among the opposition members appointed to the panel are Manish Tewari and Manickam Tagore from the Congress party, Kalyan Banerjee from the Trinamool Congress, and T. R. Baalu from the Dravida Munnetra Kazhagam. From the BJP, members include Brijmohan Agrawal and Jagdambika Pal, among others.

The Speaker of the Lok Sabha has the authority to determine which complaints of breach of privilege should be referred to the committee for detailed examination. Once a complaint is admitted, the committee reviews evidence, hears submissions if necessary and submits its report to the House. The final decision on any recommended action rests with the Lok Sabha.

Parliamentary privilege refers to special rights and immunities enjoyed by members of legislative bodies to ensure that they can perform their functions without obstruction or intimidation. Breach of privilege may include actions that obstruct or impede a member in the discharge of their duties or that undermine the authority of the House.

The reconstitution of the committee is part of routine parliamentary procedure following changes in membership or the beginning of a new session. Observers note that the functioning of the Committee of Privileges is significant in maintaining discipline and upholding the dignity of parliamentary proceedings.

With Ravi Shankar Prasad at its helm, the committee is expected to review pending matters and any new references made by the Speaker. The panel’s deliberations and recommendations will continue to play an important role in safeguarding the institutional integrity of the Lok Sabha.
