In a democracy like India, he said, the moral spine of the system is built not just through elections and governance but also through legal accountability, judicial review, and the consistent defense of citizens’ rights.

Supreme Court judge Justice Sanjay Kishan Kaul recently highlighted the critical role played by the Indian judiciary in shaping and safeguarding the moral and ethical foundation of the country's democracy. Speaking at a prominent legal conference, Justice Kaul reflected on how the judiciary has acted as a guiding force in upholding constitutional principles and protecting fundamental rights over the past seven decades.

He remarked that the judiciary is not merely an interpreter of laws but a guardian of constitutional values. In a democracy like India, he said, the moral spine of the system is built not just through elections and governance but also through legal accountability, judicial review, and the consistent defense of citizens’ rights.

Justice Kaul noted that the courts have historically stepped in during times of political or institutional uncertainty, providing checks and balances essential for democratic integrity. He cited landmark judgments in areas such as freedom of speech, privacy, equality, and social justice as examples of how the judiciary has contributed to shaping public policy and national conscience.

He emphasized that while the executive and legislature are responsible for policy and administration, the judiciary must ensure that these actions remain within the constitutional framework. He warned, however, that the judiciary must also exercise restraint and uphold its credibility by maintaining impartiality and avoiding overreach.

“In many ways, the Indian judiciary has served as the conscience keeper of the Republic. Through its evolving interpretations of the Constitution, it has expanded the scope of justice and made the rule of law meaningful for ordinary citizens,” Justice Kaul said.

He also addressed the need for improving access to justice and reducing pendency in courts. Acknowledging the challenges of delayed justice and case backlogs, he called for systemic reforms, increased digitization, and better infrastructure to strengthen the justice delivery system.

Justice Kaul encouraged young legal professionals and law students to treat their roles with seriousness and integrity. He stated that the future of Indian democracy depends significantly on how responsibly the legal fraternity carries forward the ideals of justice, fairness, and equality.

Legal experts present at the event welcomed Justice Kaul’s remarks, agreeing that the judiciary has had a transformative impact on Indian society. They pointed out that decisions on issues like environmental protection, gender equality, and civil liberties have often set benchmarks for governance and public discourse.

Justice Kaul concluded by reaffirming the importance of judicial independence and transparency in preserving public trust. He reminded attendees that the judiciary's legitimacy lies in its commitment to constitutional values, free from political or ideological bias.

In essence, his address served as both a tribute to the legacy of India’s judicial system and a call to action for its continued evolution in service of democracy and justice.

He emphasized that while the executive and legislature are responsible for policy and administration, the judiciary must ensure that these actions remain within the constitutional framework.
