Azam Khan Moves Supreme Court Against ED Arrest, Hearing Expected This Week

Senior Samajwadi Party leader Mohammad Azam Khan has approached the Supreme Court challenging his arrest by the Enforcement Directorate in a fresh money laundering case. The arrest took place shortly after he was released from Rampur jail following an Allahabad High Court order granting him bail in a separate dual PAN card case. The latest legal development has brought renewed attention to the investigations involving Khan and the Mohammad Ali Jauhar Trust in Uttar Pradesh.

Azam Khan Challenges ED Arrest

Azam Khan moved the Supreme Court on November 2, 2026, challenging the Enforcement Directorate's decision to arrest him in a money laundering investigation. His lawyer, Nizam Pasha, mentioned the matter before a bench headed by Chief Justice of India Surya Kant and requested an urgent hearing.

The bench took note of the submissions but did not agree to list the matter for an immediate hearing. The Chief Justice indicated that the petition could be listed later in the week. The case is therefore expected to come up for consideration in the coming days.

Khan's petition challenges the legality of his arrest and the subsequent judicial custody order. His legal team is seeking relief from the Supreme Court, arguing against the circumstances and timing of the ED action.

Arrest Shortly After Release From Rampur Jail

The Enforcement Directorate arrested Azam Khan on October 31, shortly after he and his son, Abdullah Azam Khan, were released from Rampur jail on bail in a separate case involving allegations related to dual PAN cards.

Khan had been in custody since November 2025 in connection with that case. The Allahabad High Court granted him bail and suspended his sentence in the matter. However, the court did not stay his conviction.

The distinction between suspension of a sentence and a stay on conviction is important. Suspension of a sentence allows a person to be released from custody subject to the conditions of bail, while the conviction itself remains in force unless a court separately stays it.

Following his release, the ED took Khan into custody in connection with a different investigation. The new arrest meant that he was not able to remain out of custody despite receiving bail in the earlier case.

Money Laundering Investigation Linked to Jauhar Trust

The latest ED case is connected to alleged financial irregularities involving the Mohammad Ali Jauhar Trust and the construction of Mohammad Ali Jauhar University in Rampur, Uttar Pradesh.

The Enforcement Directorate has been investigating allegations concerning the funding and construction of the university. The agency has alleged that funds intended for public development works were diverted for the construction of the educational institution.

The ED's investigation also involves allegations relating to the use of land and financial transactions connected with the trust. These are allegations made by the investigating agency and have not been established as findings of guilt against Khan through a final judicial decision in this case.

The agency had earlier conducted searches in connection with the investigation and questioned Khan. It also took action involving properties associated with the university under the Prevention of Money Laundering Act.

The investigation has attracted political and legal attention because of Khan's position as a senior Samajwadi Party leader and his previous role in Uttar Pradesh politics.

Special Court Orders Judicial Custody

After his arrest, Azam Khan was produced before a special court in Ghaziabad in connection with the money laundering investigation. On November 1, the court remanded him to 14 days of judicial custody.

The judicial custody order meant that Khan would remain in prison while the investigation and legal proceedings continued, unless a competent court granted him further relief.

His legal team subsequently approached the Supreme Court, challenging both the arrest and the judicial remand. The petition seeks judicial intervention over the circumstances in which the ED took him into custody.

The Supreme Court's decision to consider the petition later in the week will be an important next step in the legal proceedings. However, the court has not yet delivered a final ruling on the validity of the arrest.

Allahabad High Court's Earlier Bail Order

Before the ED arrest, the Allahabad High Court had granted bail to Azam Khan and his son in the dual PAN card case. The court suspended the sentence imposed in that matter but declined to stay their convictions.

The earlier case involved allegations concerning the possession and use of two PAN cards. Khan and his son had faced legal proceedings in connection with those allegations.

The High Court's order allowed them to secure release on bail in that particular case. However, the order did not prevent investigating agencies from proceeding with separate cases in accordance with the law.

The ED's subsequent arrest was connected to a different money laundering investigation involving the Jauhar Trust. This distinction is important because the bail granted in one case does not automatically provide protection against arrest in another legally separate case.

What Happens Next?

The Supreme Court is expected to take up Azam Khan's petition later this week after his lawyer raised the matter before the Chief Justice. The court will consider the legal grounds presented by the defence and the relief sought against the ED arrest and judicial custody order.

The proceedings may clarify the next steps in Khan's legal challenge. Until the court examines the petition and passes an order, the ED arrest and the judicial custody order remain subject to the ongoing legal process.

The case is also likely to remain a significant political development in Uttar Pradesh because of Khan's position in the Samajwadi Party. His supporters and party members have closely followed the developments surrounding his release and subsequent arrest.

For now, the immediate focus is on the Supreme Court hearing and the legal arguments concerning the ED's action. The allegations in the money laundering investigation remain allegations, and the final outcome will depend on the evidence and decisions of the competent courts.
